1. The current politico-military crisis in the Democratic Republic of the Congo is the result of a deliberate decision of the Kinshasa regime of refusing to implement the peace agreements negotiated on March 23rd, 2009 in Goma.

d) The formal statement of intent and public radio and national television by the Kinshasa Government, within a period not exceeding 24 hours, announcing the opening of direct political negotiations with the Movement of 23 March and expanded Opposition to the policy unarmed, the Civil Society and the Congolese Diaspora.

The March 23 Movement reserves the right to take all necessary measures to protect civilians in distress in case of non-compliance by the Government of one of these requirements and continue its resistance against the Kinshasa government until 'his fall.

La Direction Politique du Mouvement du 23 mars porte à l’attention de l’opinion nationale et internationale ce qui suit :

01.La crise politico-militaire actuelle en République Démocratique du Congo est le résultat de la décision délibérée du régime de Kinshasa de refuser d’appliquer les accords de paix négociées le 23 mars 2009 à Goma.

02.Le régime de Kinshasa a réservé, tout d’abord, une fin de non- recevoir aux démarches pacifiques entreprises auprès de lui pour obtenir le respect des engagements pris, pour, ensuite, opposer à ses partenaires à l’accord une action militaire en vue de les neutraliser.

06.Le 09 novembre 2012,lors d’une réunion du comité provincial de sécurité élargie au Chef d’état-major de la force terrestre des FARDC le général AMISI KUMBA dit TANGO FOUR, le Gouverneur du Nord-Kivu Julien PALUKU KAHOMGYA , agissant au nom du gouvernement de Kinshasa, lance un ultimatum de 14 jours au Mouvement du 23 mars pour désarmer et se rendre aux centres de rééducation. Dans la même nuit, les forces armées du régime de Kinshasa lancent des attaques simultanées sur nos positions à MABENGA, à KINYANDONI et à KITAGOMA dans le territoire de RUTSHURU causant la mort de 10 personnes et une vingtaine des blessés grièvement parmi la population civile et les policiers. En réaction, le M23 mettra en garde le régime de Kinshasa et menacera de répondre en cas de récidive,

07.Le 12 novembre 2012, le gouverneur de la province du Nord-Kivu annonce, au cours d’une conférence de presse organisée à sa résidence, le plan de sortie de crise du régime de Kinshasa comprenant 4 points dont l’arrestation immédiate des officiers supérieurs du Mouvement du 23 mars,

08.Dans la nuit du 14 au 15 novembre, des mouvements des chars de combat, des véhicules blindés et d’autres engins lourds de l’armée gouvernementale traverseront la ville de Goma pour se positionner sur la ligne de front à KIBUMBA. Le M23 dénoncera, a travers un communiqué, ce mouvement et préviendra l’opinion des velléités bellicistes du régime de Kinshasa,

09.Le 15 novembre2012, vers 6 heures du matin, les forces gouvernementales lancent une grande offensive sur nos positions à RUGARI, l’Armée Révolutionnaire Congolaise est instruite de se défendre et de repousser l’offensive du régime de manière à garantir la totale protection des populations civiles vivant dans les espaces contrôlés par notre mouvement. C’est cette offensive du régime de Kinshasa qui a conduit à la situation actuelle.

10.Les troupes de l’Armée Révolutionnaire Congolaise ont réussi à contenir l’offensive de l’armée gouvernementale qu’elles ont repoussée jusqu'à l’entrée de la ville de Goma provocant ainsi une série d’inquiétudes de la communauté internationale que notre Mouvement fait siennes.

11.Pour permettre une issue pacifique à la situation actuelle, notre Mouvement exige du Gouvernement de Kinshasa ce qui suit :

a) La cessation immédiate de l’offensive militaire en cours menées par les forces Gouvernementales sur les axes GOMA- KIBATI, TONGO-KALENGERA, BUSENDO-MABENGA, NGWENDA- KATWIGURU et KISEGURU-KINYANDONYI KITAGOMA où nos forces sont aux prises avec la coalition forces Gouvernementales, FDLR, groupes armés NYATURA, VUTURA– FDDP, APCLS ainsi que les MAI-MAI dits de SHETANI et de JACKSON

b) La démilitarisation totale de la ville et de l’aéroport de GOMA dans un délai ne dépassant pas 24 heures et la protection des populations civiles par les forces de maintien de la paix de la MONUSCO présentes dans la ville dans l’exercice de leur mission première.

c) L’ouverture dans les 48 heures, de la frontière de BUNAGANA pour permettre à la population vivant dans les espaces sous notre contrôle de pouvoir se mouvoir pour ses besoins vitaux comme les soins de santé , les études et l’approvisionnement en besoins de première nécessité.

d) La déclaration d’intention officielle et publique à la radio et à la télévision nationale par le Gouvernement de Kinshasa, dans un délai ne dépassant pas les 24 heures, annonçant l’ouverture des négociations politiques directes avec le Mouvement du 23 mars et élargies à l’Opposition Politique non armée, à la Société Civile et à la Diaspora Congolaise.

Le Mouvement du 23 Mars se réserve le droit de prendre toutes les mesures nécessaires en vue de protéger les populations civiles en détresse en cas de non-respect par le Gouvernement de l’une de ces exigences et poursuivre sa résistance contre le gouvernement de Kinshasa jusqu'à sa chute.
